Violation of Probation

Tampa Attorneys Handling Probation Violations

Here at the law firm of SMITH & STALLWORTH, we understand that sometimes personalities do not match and misunderstandings with a probation officer can easily occur. If you were convicted of a crime and sentenced to probation, you probably understand how important it is to fulfill certain terms and conditions of your probation. The ugly alternative is the judge can sentence you to serve up to the maximum original incarceration sentence if you are found in violation of probation.

Supervision Violations

  • Violation of Probation also known as “VOP”: Failing to comply with the terms and condition of supervision/probation, including the commission of a New Law Violation or a technical violation like not meeting with your probation officer or maintain gainful employment or a stable residence.
  • Violation of Community Control or “House Arrest”: Failing to comply with the terms and condition of stricter form of supervision than probation, including not being at home or work during the scheduled times.
  • Violation of Parole: Can refer to failing to comply with the terms and conditions of Federal supervision or release from State prison.
  • Violation of Pre-Trial Release: After Release on one’s own recognizance “ROR” or Posting bond and then failing to reappear in court. If you violate a pre-trial release agreement, a judge may revoke the bond/pretrial release and order you back into county jail.

Let’s Be Clear…

Our goal is to have the violation of probation charges against you dismissed, dropped, or reduced. Many times we are even able to get the probation, house arrest, or community control, terminated all together! Our track record supports this.

New Law Violations

Any time a probationer commits a new crime while on probation, the courts consider such a violation a “new law violation” of probation. On the other hand, a “Technical Violation” of probation refers to any other violation that occurs, not involving a new crime or new law violation, such as a failed urine screen, failure to report to one’s probation officer, failure to pay probation costs, etc.

Technical Violations

Technical probation violations include missing or being late to a probation meeting, failing to pay fines ordered by the court or moving without telling your probation officer. A substantive probation or parole violation occurs if you commit another crime.

Hillsborough County Circuit Court Felony VOP Judge
